FINE SCHEDULE
1. No fine shall be assessed until the Owner who has committed a violation has been given due written notice and opportunity for a hearing.
2. Monetary fines for violations of the governing documents and rules and regulations of the Association are as follows:
In most cases a warning notice will be issued before an official violation with fine is issued. However, this is not a requirement for a fine to be assessed against a unit. If, in the sole opinion of the board, the violation is egretious or may risk the safety and security of our residents, NO WARNING WILL BE ISSUED PRIOR TO FINES BEING ASSESSED.
First Violation $100
Second Violation (of the same nature) $200
Third Violation (of the same nature) $300 Each Violation after the third (of the same nature) $500 and Legal charges may be filed.
NO WARNINGS WILL BE ISSUED FOR FAILURE TO REPORT NEW RESIDENTS OR REGISTERING LEASE TERMS. THESE VIOLATIONS WILL RESULT IN FINES FROM $250-$1000 AND LEGAL FILINGS FOR HABITUAL VIOLATIONS.
3. The Board shall have the authority to deviate from these FINE GUIDELINES based on application of several factors
4. It is the obligation of the Owner to advise the Association in writing that the violation has ceased.
Late fees for unpaid fines will be applied as per Arizona statute and the CCRs
